You may have concerns such as:
  • The estate administrator is misusing funds, is hiding information, has a gambling problem, or has debts or other money trouble.
  • A Beneficiary who was expecting a greater share and has had his or her share reduced or eliminated.
  • A Spouse who is not the primary beneficiary of the estate has several options, and the time to exercise those options expires quickly
  • Any person who is financially dependent but does not receive a benefit under the will may sue the estate for support.
  • A Power of Attorney is misappropriating funds for his or her own benefit.

You may have concerns such as:
  • The Will has multiple interpretations and you are unsure of which distribution is correct. An application to Court for advice and directions will absolve you of liability for an improper distribution.
  • A Beneficiary is insisting on a distribution that you believe is contrary to the Will, and threatening to sue.
  • The Estate holds debts against another person who is refusing to pay. It is your duty as an executor to consider enforcing the debt on behalf of the estate.
  • The Estate has been sued by a creditor for payment of a debt. Your duty is to defend the estate against a claim, or to pay the just debts. What if there is not sufficient assets remaining in the estate?
